THE PINK IN THE RED OVER ADULT ENTERTAINMENT

The licensee of Brisbane pub The Pink has been found guilty and fined for providing adult entertainment on the premises without a permit.

The licensee of the Pinkenba Hotel, The Pink (Qld) P/L, was prosecuted in Brisbane Magistrates Court late September for not having a permit to conduct the Miss Pink Erotica 2019 event. Female dancers performed in an explicit sexual manner in the venue.

Queensland’s licensing regulator states licensing framework aims to protect both the community and adult entertainment workers, by ensuring such activities are only provided and controlled by suitable people, that minors are not exposed, and that adequate supervision is provided to protect the entertainers.

Accordingly, a permit is required to conduct this type of event. Victoria Thomson, Commissioner for Liquor and Gaming, said the licensee showed “clear disregard” for the Liquor Act.

“The rules are clear – you must apply for an adult entertainment permit to provide sexually explicit entertainment on a licensed premise.

“Licensees have a legal obligation to uphold Queensland’s licensing laws, and a social responsibility to do the right thing.”

Thomson notes any licensee considering adult entertainment within their premises should fully understand what constitutes adult entertainment, the limitations that apply to performances, and the relevant approvals required.

Appearing before the Court, the defendants entered a plea of guilty to the charge. Licensees can be fined up to 200 penalty units ($26,690) for conducting adult entertainment without a permit.

The Magistrate accepted the guilty plea, not recording a conviction and imposing a fine of $3,000, but indicated the penalty would have been far greater if not for the impacts of COVID-19.

Since the 2019 event, the pub has rebranded to become the Trade Coast Hotel.
